Normally, trademark owners in the U.S. cannot enforce the federal Lanham Act against parties that are using their registered marks solely outside the United States. Nevertheless, a recent decision by a federal appeals court allowed Trader Joe’s to maintain a lawsuit against a Canadian store called Pirate Joe’s. The owner of Pirate Joe’s regularly purchased Trader Joe’s products in the State of Washington and resold them at Pirate Joe’s in Vancouver, Canada.
